What is credit card fraud?
Credit card fraud refers to a diverse array of offences, ranging from small, single cases of credit card fraud to fraud on a massive scale, with multiple parties involved in the defrauding of large quantities of money. Most of these crimes will be covered under the Fraud Act 2006, although they can also be covered by the theft act 1968. A few different examples of crimes that constitute credit card fraud are:
- Internet credit card fraud: A crime where false sites are created online that don’t sell a product, and instead gather credit card data to be used for later fraudulent transactions.
- Skimming: Skimming includes the use of a device to gather credit card data, often in a shop or at a cash machine. That data is then later used to defraud the owner of the card.
- False credit card applications: This consists of using false and illegally obtained details to apply for a credit card fraudulently. It’s often combined with some form of identity theft.
Sentencing for credit card fraud
Sentencing for credit card fraud varies massively depending on how severe the specific case is. If the case is severe enough to go to court, sentences will often be between 4-5 years, with a maximum sentence of 10 years imprisonment. Which sentence you receive will depend on a number of variables; these include your past criminal record, how much money was gained or caused to be lost via the fraud, and how large a conspiracy the fraud consisted of.
